It is assumed that you have read, understood and accepted our policies and conditions before you place your order. All terms, policy and conditions stated will apply to all accepted orders. All previous representations and statements, whether verbal or written, shall be deemed to be superseded.
Order Cancellation and Title Cancellations must be made in writing, call immediately to notify. If an order has already been submitted to the manufacturer, a 45% of the purchase total restocking charge will be incurred. Title to all furniture shall pass from the manufacturer to the purchaser (a) upon delivery to purchaser or (b) at the local warehouse' shipping dock when goods are picked up by a purchaser's agent/ carrier at which point risk of loss or damage shall be upon the purchaser. Taxes Prices as noted do not include any taxes payable. Purchaser takes responsibility and agrees to pay all taxes (local, state and federal) payable by law with respect to this transaction, and any discrepancy, error or penalties that might be disclosed in the future due to unpaid taxes. Purchasers that fail to provide government issued tax exemption certificates or forms are held fully responsible to comply with all sales tax by the municipality, state or federal agency. Prices as noted do not include any & all taxes payable. Delayed shipments / Storage costs ICF Inc. will not be liable for delays related to fabric back order, ocean freight, fires, strikes, customs and federal inspections, weather conditions, or any other situation that may arise beyond our control. Once the production cycle has commenced there is limited ability to delay the manufacturing process, therefore upon the completion of the order a delivery appointment will be scheduled. Should a situation arise where ICF Inc. is required to coordinate offsite storage, it reserves the right to charge all related costs to the customer. Upholstery: Upholstery fabrics are dyed by the fabric manufacturer at the mill toward the master color that is shown on the swatch cards and samples. Each dye lot is slightly different from every other. This difference shall not constitute reason for rejection by Purchaser of the upholstery fabric. Frame finishes: Powder paint is formulated by the powder manufacturer toward the master color that is shown on the paint chips. Slight variances in the final frame finish (especially the two-tone powders) should be expected, these finish variation shall not constitute reason for rejection by the Purchaser including but not limited to finish discoloration or any other effects due to humility, heat and UV Ray levels. Return Policy: Because of the product's nature, custom built or custom manufactured cannot be returned. If a manufacturer has a written return policy or agrees to take an item/s back then the customer can send the applicable product back to that factory but is responsible for all restocking fees and shipping costs in both directions. Please be aware that if you return one of these products our actual outbound shipping costs will be deducted from your return refund. You will also be responsible for shipping the merchandise back to us. All returns must be in the original condition and packaging.
Installation, Safety and Freight Damage Please note that freight lines are not operated by us and we are subject to their delivery schedules and rules. Unless otherwise agreed, all shipping quotes include tailgate delivery service only. Upon arrival of the carrier, the Purchaser agrees to provide the labor required to unload the carrier, down stack the chairs, remove all packaging materials and to place the chairs inside the facility. All packaging materials are to be disposed of by the Purchaser. Under no conditions are packaging materials to be left with the carrier/driver. Purchaser accepts responsibility for the safety of all persons. Purchaser shall also defend and save ICF Inc harmless from all claims from persons who are injured on the premises where delivery and/or installation are performed. Damaged merchandise will be replaced and/or repaired at our discretion. It is the responsibility of the purchaser to inspect ALL shipments received for freight damage. Make the truck driver wait for you while you inspect the chair. Failure to inspect and reject the chair will result in loss of protection.
Refuse the damaged chairs note any damage on the shipping ticket and after you have properly noted any damage, contact us for proper procedure in replacement options. Failure to inspect the chair and follow the policy will result in loss of protection.
Internet Pricing Prices are subject to change at any time. Pricing errors can occasionally occur. We are not responsible for these pricing errors and will notify the buyer immediately upon finding these errors.
Governmental regulation Compliance, condition or requirement with all government and federal laws, codes and regulations, including but not limited to building and fire codes applicable to this purchase shall be the responsibility of the Purchaser. Purchaser is responsible to notify and solicit any design or construction requirement prior to the purchase shall be the responsibility of the Purchaser. Warranty Information The warranties of our chairs range from 30 days, 5 years and 10 years limited warranty depending on chair model. Our warranties are on the structural metal frame only. ICF Inc. will assist the client in submitting the claim to the manufacturer but will not be held responsible in any matter. The Warranty excludes fabric, foam and attachment parts such as leg gliders, leg bumpers, bookracks, cup holders, ganging device and armrest. All chairs offered under discount, liquidation, clearance, special sale or damaged goods are final and sold as is and are sold with no warranty. Warranty excludes damages related but not limited to rusting, fabric fading, fabric tear and wear, stitching, lose of foam density, misuse or abuse, discoloration due to UV rays, direct or indirect exposure to sunlight or light bulbs and tubular damage due to rust or weight load that exceeds its use and design capacity. The client is responsible to ensure that all preventive measures are taken to protect and preserve the lifespan of its product including but not limited to UVR protection on windows, doors, and light fixtures, humidity control, weight overload, anti-stain treatment, anti-rust treatment etc, these measures may vary due to climax, humidity levels, UVR exposure, etc. failing to follow this measures can result in lost of warranty coverage at ICF discretion. Any maintenance, service, repair or cleaning products not approved by the manufacturer will void the warranty by the manufacturer. The purchaser is responsible to contact ICF, Inc for instructions on how to care for the chairs. Warranty Claim To claim a warranty client must transport the damaged product to our repair and service facilities. Submit a written statement of the damage with date of the incident, with a detailed description of the damage including but not limited to how the damage came about. Once and if the claim has been approved for repair or replacement under the warranty’s guidelines, the Purchaser is solely responsible for all expenses related to replacement labor and shipping charges if applicable. The company reserves the right to proceed at its own discretion.
Exclusions the warranty’s exclusions include but are not limited to all chair offered under discount, liquidation, clearance, special sale or damaged goods are final and sold as is. The Warranty also excludes fabric, foam and attachment parts (Accessories) such as leg gliders, leg bumpers, bookracks, cup holders, ganging device and armrest The warranty also excludes damages due to fabric tear and wear, any fabric damage caused by UVR or high humidity levels, metal rusting and chair bending or breaking due to rust, accidental damages or weight over load.
Repair or replacement timelines and conditions The unit can be brought to Service center. The manufacturer rep. will make every effort to complete repairs or replacement in a timely manner. Our production load and/or availability of materials may affect this. If at anytime the original materials or tooling is not available, The Company will match the repair parts as closely as possible; this difference shall not constitute reason for rejection by Purchaser. All units returned for repair will be reviewed at the company’s discretion. If at anytime we find a unit that is not covered under warranty guidelines, an estimate for repair or replacement will be made and the customer will be contacted for approval.
